1. Acceptance of Terms

By downloading, installing, or using the Orbi mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and AppLab Kamil Piekarz ("we," "us," or "our").

2. Description of Service

Orbi is an AI chatbot and assistant application that provides access to multiple artificial intelligence models, including but not limited to GPT-5 (OpenAI), Claude 4.5 (Anthropic), and Gemini 2.5 Pro (Google). The App offers the following features:

  • AI-powered chat conversations with multiple AI models
  • AI image generation and editing from text prompts
  • Document and PDF summarization
  • Math problem solving with step-by-step explanations
  • Code generation, debugging, and explanation
  • AI writing assistance
  • Text-to-speech functionality
  • AI character personalities for specialized interactions
  • Multi-language support (12 languages)

3. Account Registration

To use certain features of the App, you may be required to create an account through Firebase Authentication. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

Orbi offers both free and premium (Orbi Pro) subscription tiers. Premium subscriptions provide access to advanced AI models and additional features. Subscription details, pricing, and available plans are displayed within the App.

4.2 Billing

Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device platform. All payments are processed by Apple or Google — we do not directly handle payment information. By subscribing, you agree to the payment terms of the respective platform.

4.3 Free Trial

We may offer a free trial period for premium subscriptions. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged according to the selected plan.

4.4 Cancellation and Refunds

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. Refund requests are handled by Apple or Google according to their respective refund policies.

4.5 Restore Purchases

You can restore previous purchases within the App. This feature allows you to recover your subscription status when switching devices or reinstalling the App.

5. Acceptable Use

You agree not to use the App to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Infringe upon the intellectual property rights of any third party
  • Attempt to gain unauthorized access to the App, its servers, or any connected systems
  • Use automated means (bots, scrapers) to access the App or its content
  • Reverse engineer, decompile, or disassemble the App
  • Circumvent any security measures, including Firebase App Check
  • Use the App to generate spam, phishing content, or malware
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the App in any way that could damage, disable, or impair the service

6. AI-Generated Content

6.1 Nature of AI Responses

AI-generated content is produced by third-party AI models (OpenAI, Anthropic, Google) and may not always be accurate, complete, or up-to-date. The App is a tool to assist you, not a replacement for professional advice.

6.2 No Warranty on AI Output

We do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content. You should independently verify any information, code, or advice provided by the AI models before relying on it, especially for medical, legal, financial, or safety-critical decisions.

6.3 Content Ownership

You retain ownership of the content you submit to the App (prompts, documents, images). AI-generated responses are provided to you for your use, subject to the terms of the respective AI model providers. You are responsible for ensuring your use of AI-generated content complies with applicable laws and third-party rights.

7. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is the property of AppLab Kamil Piekarz and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

To the maximum extent permitted by applicable law, AppLab Kamil Piekarz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the App.

We are not responsible for any actions taken based on AI-generated content, including but not limited to code execution, medical decisions, financial actions, or legal decisions.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or secure. AI models may experience downtime, produce inaccurate results, or be temporarily unavailable.

11. Service Availability

We strive to maintain the availability of the App but do not guarantee uninterrupted access. We may temporarily suspend the App for maintenance, updates, or due to circumstances beyond our control. AI model availability depends on third-party providers and may change without notice.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. This includes adding or removing AI models, features, or subscription plans. We shall not be liable for any such modifications.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts of Poland.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
